Terms of Service

SamInterest LLC d/b/a Chronos AI ("Hypercruit")
Please read these Terms carefully. By creating an account or using any Hypercruit service, you agree to be bound by these Terms of Service. If you do not agree, do not use our platform. These Terms constitute a legally binding agreement between you and SamInterest LLC d/b/a Chronos AI.
Section 01
Acceptance of Terms
By accessing or using the Hypercruit platform, website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific features or services. These Terms apply to all users, including candidates, employers, administrators, and state or government agency users.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Section 02
Description of Services
Hypercruit is an AI-powered workforce intelligence platform that connects candidates with employment opportunities through verified profiles, credential authentication, and intelligent job matching. Our Services include:
- AI-powered job matching and career recommendations
- Candidate profile creation, resume upload, and credential management
- Identity verification and background check facilitation
- Employer job posting, candidate pipeline management, and hiring workflows
- Interview preparation tools and career development resources
- Analytics and reporting for workforce agencies and employers
- Integration with state, federal, and tribal workforce programs
- Multilingual support and culturally responsive career services
Hypercruit does not guarantee employment, placement, or specific job matches. We provide tools and connections — outcomes depend on candidate qualifications and employer decisions.
Section 03
Eligibility & Account Registration
To use Hypercruit, you must be at least 16 years of age. Users between 16 and 18 must have parental or guardian consent. By creating an account, you represent that all information you provide is accurate, current, and complete.
Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access. Hypercruit is not liable for losses resulting from unauthorized use of your account.
One Account Per Person
Candidates may maintain one individual account. Creating multiple accounts to circumvent restrictions or misrepresent your identity is prohibited and will result in termination of all accounts.
Section 04
Candidate Terms
Profile Accuracy
You agree that all information in your candidate profile — including work history, education, credentials, skills, and references — is truthful and accurate. Misrepresentation of qualifications is grounds for immediate account termination and may expose you to legal liability with prospective employers.
Resume & Document Uploads
By uploading documents, you grant Hypercruit a limited license to process, store, and share those documents with employers and agencies you authorize. You retain ownership of your documents.
Verification Consent
By initiating identity or credential verification, you authorize Hypercruit and its verification partners to access and confirm the information you have provided. You will be presented with specific consent disclosures before any verification process begins.
AI Matching
You understand that job matches are generated by AI algorithms and may not be perfect. Match scores are advisory — final hiring decisions rest entirely with employers. You may opt out of AI matching at any time in your account settings.

Employer Terms
Job Posting Standards
Employers agree that all job postings are for legitimate, actual open positions. Postings must comply with all applicable federal, state, and local employment laws including equal opportunity requirements, salary transparency laws where applicable, and anti-discrimination statutes.
Candidate Data Use
Candidate information accessed through Hypercruit may only be used for hiring purposes. Employers may not sell, transfer, or use candidate data for marketing, research, or any purpose unrelated to the specific hiring process for which it was accessed.
Non-Discrimination
Employers agree not to discriminate against candidates on the basis of race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity, veteran status, or any other characteristic protected by applicable law.
Subscription & Payment
Employer access is subject to the subscription plan selected at registration. Fees are non-refundable except as required by law or as specified in your service agreement. Hypercruit reserves the right to modify pricing with 30 days notice.

FCRA Disclosure & Authorization
⚖️ Fair Credit Reporting Act (FCRA) Disclosure — Required by Federal Law
IMPORTANT NOTICE TO CANDIDATES: In connection with your application for employment or career placement through Hypercruit, a consumer report (background check) may be obtained. This report may include information about your character, general reputation, personal characteristics, criminal history, credit history, and mode of living.
Your Rights Under the FCRA: You have the right to request disclosure of the nature and scope of any background investigation. You have the right to receive a copy of any consumer report obtained. If any adverse employment action is taken based on information in a consumer report, you have the right to know, to receive a copy of the report, and to dispute inaccurate information with the consumer reporting agency.
Separate Authorization Required: Before any background check is initiated, you will be presented with a separate, standalone FCRA authorization form that must be signed electronically. No background check will occur without your explicit written consent.
Hypercruit facilitates background check services through third-party consumer reporting agencies. We do not make employment decisions based on background check results — that determination rests with the employer. All background checks are conducted in compliance with the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) and applicable state laws.
Section 07
Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information in any profile, posting, or communication
- Scrape, harvest, or collect data from the platform without written authorization
- Use the platform to discriminate against protected classes in violation of applicable law
- Post fake job listings, ghost candidates, or engage in predatory recruiting practices
- Attempt to reverse-engineer, hack, or interfere with platform security or functionality
- Use automated bots or scripts to interact with the platform without authorization
- Harass, stalk, or threaten other users through messaging or any platform feature
- Use candidate data obtained through Hypercruit for any purpose other than legitimate hiring
- Circumvent subscription or payment requirements through unauthorized means
- Violate any applicable local, state, federal, tribal, or international law
Violations may result in immediate account termination, legal action, and reporting to appropriate authorities including law enforcement and regulatory agencies.
Section 08
Intellectual Property
The Hypercruit platform, including its AI matching engine, synonym intelligence system, credential verification architecture, design, software, and all associated technology, is owned by SamInterest LLC d/b/a Chronos AI and protected by U.S. and international intellectual property laws.
You retain ownership of content you upload (resumes, credentials, documents). By uploading content, you grant Hypercruit a limited, non-exclusive license to process and display that content to facilitate the Services. This license terminates when you delete your account or remove the content.
The Hypercruit name, logo, and "Verified Talent. Accelerated Outcomes." tagline are trademarks of SamInterest LLC. Unauthorized use is prohibited.
Section 09
Data & Privacy
Your use of Hypercruit is also governed by our
Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your data as described in the Privacy Policy.
Data Retention
We retain your data for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion of your account and associated data at any time by contacting support.
International Users & GDPR
If you are located in the European Economic Area, United Kingdom, or other jurisdictions with data protection laws, additional rights and protections apply. Please refer to our Privacy Policy for jurisdiction-specific disclosures. By using the Services, you consent to the transfer of your data to the United States where our servers are located.
Tribal Nation Data Sovereignty
Hypercruit recognizes and respects tribal data sovereignty principles. Data relating to members of federally recognized tribal nations is handled in accordance with applicable tribal law and our tribal partnership agreements. Tribal nations using the platform retain governance rights over their member data as specified in their individual service agreements.
Section 10
Disclaimers & Limitation of Liability
No Employment Guarantee. Hypercruit does not guarantee that use of our Services will result in employment, job offers, interviews, or any specific career outcome. AI match scores are informational and not guarantees of fit or employer interest.
Platform Availability. The Services are provided "as is" and "as available." We do not warrant uninterrupted or error-free operation. We may modify, suspend, or discontinue the Services at any time.
Third-Party Services. Hypercruit integrates with third-party job boards, verification services, and data providers. We are not responsible for the accuracy, availability, or practices of third-party services.
Limitation of Liability. To the maximum extent permitted by law, SamInterest LLC's total liability for any claim arising from these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.
Section 11
Equal Employment Opportunity
Hypercruit is committed to equal opportunity in employment and career development. Our platform is designed to reduce bias in hiring by focusing on verified skills, credentials, and AI-assessed fit rather than demographic characteristics.
All employers using the platform agree to comply with:
- Title VII of the Civil Rights Act of 1964
- The Americans with Disabilities Act (ADA)
- The Age Discrimination in Employment Act (ADEA)
- The Equal Pay Act
- Executive Order 11246 (federal contractors)
- All applicable state and local equal employment opportunity laws
Hypercruit reserves the right to remove employer accounts that engage in discriminatory hiring practices.
Section 12
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Services shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the American Arbitration Association rules, conducted in Oklahoma County, Oklahoma.
You waive any right to participate in class action lawsuits or class-wide arbitration related to the Services. This waiver does not apply to claims for injunctive or declaratory relief.
Tribal Nation Exception: Nothing in these Terms waives or limits the sovereign immunity of any federally recognized tribal nation using the platform under a tribal government agreement.
Section 13
Changes to Terms
Hypercruit reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or in-platform notification at least 14 days before changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
If you do not agree to updated Terms, you must stop using the Services and may request account deletion by contacting support.
