Hypercruit is operated by SamInterest LLC d/b/a Chronos AI, an Oklahoma-based workforce technology company. We are the "data controller" for personal information collected through the Hypercruit platform, website, and related services.
We are registered with the U.S. System for Award Management (SAM.gov) and hold Women-Owned Small Business (WOSB) and Minority-Owned Business (MBE) designations. We operate in compliance with U.S. federal law, Oklahoma state law, and applicable international data protection regulations.

Information You Provide

- Documents: Resume, cover letters, diplomas, certificates, identification documents
- Verification Data: Government-issued ID information for identity verification

- Communication: Messages sent through our platform, feedback, and support requests
- Payment Information: Billing details for employer subscriptions (processed by secure third-party processors)
Information We Collect Automatically
- Usage Data: Pages visited, features used, search queries, click patterns
- Device Information: IP address, browser type, operating system, device identifiers
- Log Data: Access times, errors, API calls
- Location Data: General location based on IP address (not precise GPS)
- Analytics Events: Interactions tracked to improve platform performance
Information From Third Parties
- Job data from integrated sources including USAJobs, Adzuna, Jooble, Greenhouse, and other job feeds
- Identity and credential verification results from our verification partners
- Background check reports from licensed consumer reporting agencies (with your consent)
- Social login information if you choose to sign in with LinkedIn or Google

How We Use Your Information
We use your information to:
- Create and manage your account and provide platform Services
- Generate AI-powered job matches based on your skills, experience, and preferences
- Verify your identity, credentials, and employment history
- Connect you with employers and facilitate the hiring process
- Send relevant job alerts, match notifications, and platform updates
- Provide interview preparation and career development tools
- Analyze platform usage to improve our Services and AI matching accuracy
- Comply with legal obligations including FCRA, EEO, and applicable employment laws
- Generate workforce analytics for authorized state and government partners
- Detect fraud, prevent abuse, and protect platform security
- Process payments and manage employer subscriptions
We do not sell your personal information to third parties for marketing purposes. We do not use your data to train external AI models without your explicit consent.

How We Share Your Information
With Employers
When you apply to a job or are matched with an employer, we share your profile information with that employer. You control which elements of your profile are visible. Employers agree contractually to use your information only for hiring purposes.
With State & Government Partners
If you access Hypercruit through a state workforce agency, CareerTech center, or tribal nation program, that organization may receive aggregate and individual analytics related to your career pathway. This sharing is governed by our agreements with those partners and applicable law.
With Service Providers
We share data with trusted service providers who help us operate the platform — including cloud hosting, email delivery, background check agencies, identity verification services, and payment processors. All providers are contractually bound to protect your data.
For Legal Compliance
We may disclose information when required by law, court order, or government request, or when necessary to protect the rights, property, or safety of Hypercruit, our users, or others.
Business Transfers
In the event of a merger, acquisition, or sale of assets, your information may be transferred to the successor entity. We will notify you of any such transfer and the opportunity to delete your account.

Data Security
We implement industry-standard security measures to protect your personal information:
- Encryption in transit (TLS/HTTPS) and at rest for sensitive data
- Access controls limiting employee access to personal data on a need-to-know basis
- Regular security assessments and vulnerability monitoring
- Secure authentication including hashed password storage
- Cloudflare DDoS protection and web application firewall
- Audit logging of all data access and export events
No system is perfectly secure. In the event of a data breach that affects your rights, we will notify you as required by applicable law — within 72 hours for GDPR-covered users and as required by applicable U.S. state breach notification laws.

GDPR & International Users
🇪🇺 European Union / EEA / UK Users
If you are located in the European Economic Area, United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and UK GDPR apply to our processing of your personal data.
Legal Basis for Processing: We process your data based on: (1) contractual necessity — to provide the Services you signed up for; (2) legitimate interests — to improve our platform and prevent fraud; (3) legal obligation — to comply with applicable law; and (4) consent — for optional features like marketing communications.
International Transfers: Your data may be transferred to and processed in the United States. We use Standard Contractual Clauses (SCCs) and other appropriate safeguards for such transfers.
Right to Lodge a Complaint: You have the right to lodge a complaint with your national data protection authority if you believe we have violated your privacy rights.

California Privacy Rights (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with additional rights:

- Right to Delete: Request deletion of your personal information
- Right to Opt-Out: We do not sell personal information. You may opt out of sharing for cross-context behavioral advertising
- Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights
- Right to Correct: Request correction of inaccurate personal information
- Right to Limit: Limit use of sensitive personal information

Tribal Data Sovereignty
🏹 Tribal Nation Data Rights
Hypercruit recognizes the inherent sovereignty of federally recognized tribal nations and their right to govern data relating to their citizens and members. We are committed to the principles of Indigenous Data Sovereignty (IDSov) and the CARE Principles for Indigenous Data Governance.
For Tribal Government Partners: Data relating to tribal citizens accessed through tribal government agreements is subject to the data governance terms of that agreement, which may provide the tribal nation with greater control over data collection, use, and retention than described in this general Privacy Policy.
Tribal Citizen Rights: Members of federally recognized tribes using Hypercruit through a tribal program may have additional data rights as specified in their tribe's agreement with us. Please contact your tribal workforce program for details.
Language Support: Hypercruit supports Cherokee and Muscogee (Creek) language interfaces in recognition of our Oklahoma tribal nation partnerships. Language preference data is used only to provide the correct interface and is not shared for other purposes.

Cookies & Tracking
We use cookies and similar tracking technologies to operate and improve the platform:
- Essential Cookies: Required for authentication, security, and core functionality. Cannot be disabled.
- Analytics Cookies: Help us understand how the platform is used to improve performance. Can be opted out.
- Preference Cookies: Remember your language, theme, and display preferences.
We do not use third-party advertising cookies. We do not participate in cross-site tracking for advertising purposes. You can manage cookie preferences in your browser settings. Note that disabling essential cookies will impair platform functionality.
Cloudflare, our security and CDN provider, may set cookies for security and performance purposes. These are governed by
Cloudflare's Privacy Policy.
Section 11
Children's Privacy
The Hypercruit candidate platform is intended for users 16 years of age and older. Users between 16 and 18 must have parental or guardian consent. We do not knowingly collect personal information from children under 13.
The HyperStart K-6 educational platform (a separate Hypercruit product) is designed for children under 13 and is governed by COPPA (Children's Online Privacy Protection Act). School accounts for HyperStart require institutional authorization and parental consent mechanisms appropriate for the age group.
If you believe we have inadvertently collected information from a child under 13 on the main Hypercruit platform, please contact us immediately at privacy@hypercruit.net and we will delete that information promptly.
Section 12
Data Retention
We retain your personal information for as long as your account is active or as needed to provide Services. Specific retention periods:
- Active accounts: Data retained for duration of account plus 3 years after closure
- Background check records: 7 years as required by FCRA
- Financial records: 7 years for tax and accounting compliance
- Audit logs: 3 years for security and compliance purposes
- Deleted accounts: Most data deleted within 30 days; some retained longer for legal compliance
You may request earlier deletion of your data by contacting us. Some data may be retained longer if required by law, pending legal proceedings, or for legitimate business purposes such as fraud prevention.
Section 13
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or business operations. We will notify you of material changes by:
- Sending an email to your registered address at least 14 days before changes take effect
- Displaying a prominent notice in the platform
- Updating the "Last Updated" date at the top of this Policy
Your continued use of the Services after the effective date of changes constitutes acceptance of the updated Policy. If you do not agree to changes, you may close your account before the effective date.
